Draft for approval
Draft 1.0 · 25 October 2026. Operator details and procedures must be completed and the document legally reviewed before contracts are offered. The current form submits an enquiry: it does not conclude a contract or require acceptance of this draft as binding terms.
1. Operator, scope and nature of the service
- Po Kociemu is the name of a small, home-style cat boarding service in Toruń. Before entering into contracts, the operator must add the full business name or the proprietor’s full name, business and complaints addresses, tax identification number (NIP), the relevant CEIDG or KRS registration where applicable, and an active email address. The trading name “Po Kociemu” alone does not identify the contracting party.
- For arrangements, call +48 664 668 340. The service is based in Toruń; the exact drop-off and collection address is provided before a contract is concluded. Stay arrangements are confirmed in a message the owner can retain.
- Only cats are admitted. Dogs are not accepted. Care for other small animals is a future plan and is not part of the current service.
- The service provides attentive care according to individual arrangements. It is not veterinary treatment, hospital care or round-the-clock medical supervision. A cat’s special needs must first be assessed to establish whether they can be met safely.
2. Enquiries, bookings and the contract
- The “Enquire about a stay” form submits a non-binding enquiry. An enquiry reference, automated message or preliminary conversation does not confirm room availability or create an obligation to pay.
- Before the contract is concluded, the operator provides their identification details, dates and arrival and collection times, number of cats, room arrangements, care included, total price, any additional charges, payment and cancellation arrangements, the applicable version of the terms and consumer information.
- A contract is concluded when both parties explicitly accept the same arrangements in the agreed form. For a distance contract, confirmation and the agreed terms are supplied on a durable medium, such as an email. A link to a page that can later be edited does not replace a retained copy of the agreement.
- If an advance payment is agreed, its amount, due date and the consequences of non-payment are stated in the confirmation. The current form does not collect payment automatically. Changes to dates, number of cats or care requirements need fresh confirmation of availability and price.
- The person handing over the cat confirms that they are its owner or are authorised to arrange care, provide the necessary information and agree veterinary arrangements. They provide accurate contact details and an emergency contact authorised to act.
3. Mandatory vaccinations and records
- Only cats with up-to-date vaccinations documented in a vaccination certificate or pet health record are accepted. On arrival, the owner must show a record that identifies the cat concerned. A cat without proof of current vaccinations cannot be admitted.
- The required vaccinations and interval between vaccination and arrival are agreed before the stay is confirmed, taking account of veterinary advice and the vaccine used. These terms do not replace an individual veterinary assessment.
- The owner provides information about illness, suspected infection, recent exposure to infectious disease, parasites, ongoing treatment and veterinary instructions. Any significant change between booking and arrival must also be reported.
- A medical contraindication to vaccination is not an automatic exception to the vaccinated-guests-only policy. Alternative care should be arranged if the cat does not qualify. Any cancelled stay is settled under the cancellation provisions.
4. Health, behaviour and refusal of admission
- Before booking, the owner describes the cat’s personality, tolerance of handling, escape attempts, stress responses, aggression, scent marking, litter-tray habits and any other relevant needs. Previous difficulties when staying away from home must also be disclosed.
- A cat with a chronic condition, a cat recovering from surgery, or one needing medication, a special diet, additional hygiene or ongoing observation may only be admitted by prior agreement and after confirming that suitable care is possible. A cat requiring hospital treatment should not be brought to the hotel.
- Admission may be refused for justified reasons: missing vaccination records, signs or reasonable suspicion of infectious disease, active parasites, a condition requiring urgent veterinary attention, or behaviour presenting a risk the hotel cannot safely manage. The reason is explained and recorded.
- Refusal does not automatically forfeit all payments. The parties settle the unperformed service and any justified claims. If the hotel cannot provide the properly agreed service for reasons attributable to it, it refunds the unprovided care without affecting the customer’s other rights.
5. Arrival, care record and belongings
- Drop-off and collection times must be agreed. The cat must arrive in a sound, closed carrier, which the owner must not open until the carer identifies a safe place. Cats must not be released outside the building or in the hallway.
- At handover, a stay record is prepared covering the cat and owner’s identification, collection authorisation, emergency contact, dates, observed condition, feeding, needs, medication, veterinary information, agreed costs and an inventory of belongings. The microchip number is recorded if the cat has one.
- The owner supplies enough of the cat’s usual wet food for the agreed stay, feeding instructions and any special dietary products. Dry food is available within the agreed service; any restrictions on access to it must be clearly communicated.
- A familiar blanket and safe items carrying the scent of home are recommended. The hotel may decline items that pose a swallowing, entanglement or injury risk. Valuables should be left at home; handing them over requires a specific agreement and record.
- Medication must be supplied in its original packaging with clear labelling and written veterinary instructions specifying the dose and administration. The hotel does not alter treatment independently or accept duties its carers cannot safely perform.
6. Daily care and safety
- A room is allocated to one cat or an agreed group from the same household. Cats from different households are not placed together. If cats from one home need separating, the operator contacts the owner and agrees an appropriate solution.
- Care includes agreed feeding, access to water, a clean litter tray, observation of wellbeing, and interaction and activity suited to the cat’s responses. Time may be needed to settle in; physical contact and play are not forced.
- The hotel uses precautions against escape, keeps equipment clean and limits contact that could spread disease. Owners follow instructions about doors, windows, carriers and movement around the premises.
- Reduced appetite, withdrawal or other signs of stress do not alone establish inadequate care, but require observation and an appropriate response. Concerning or persistent symptoms are handled under the veterinary procedure. The hotel does not promise a completely stress-free stay or guarantee that illness will never occur.
- Owner visits and updates take place as agreed and with regard for all cats’ peace and quiet. Photo updates are not unlimited or automatically available around the clock; arrangements are stated in the stay confirmation.
7. Illness, emergencies and veterinary care
- The owner remains reachable or provides a person authorised to make urgent decisions. Before the stay, the parties record the preferred veterinary practice, the scope of authorisation and a spending limit for routine consultations.
- If symptoms require attention, the hotel promptly attempts to contact the owner or emergency contact. Consultation and transport are arranged according to the cat’s condition, practice availability and veterinary instructions. The hotel does not diagnose conditions or independently carry out procedures reserved for a vet.
- If delay may endanger the cat’s life or health and contact cannot be made, the hotel seeks essential veterinary help within the authorisation given and applicable law. Inability to contact the owner does not justify leaving the animal without help. The owner is informed as soon as contact becomes possible.
- Whenever circumstances allow, expenditure above the agreed limit must be authorised by the owner. In an emergency, the vet assesses the necessary action. The hotel records contact attempts, advice, transport and expenditure and supplies receipts, without an arbitrary markup on treatment.
- Justified, necessary veterinary costs and agreed transport are settled with the owner, taking account of the cause of the incident and the applicable rules on liability. These terms do not transfer to the owner the cost of harm caused by the hotel’s own fault.
- Suspected infectious disease may require restricted contact, consultation, early collection or transfer to a suitable veterinary practice. The response is intended to protect the animals and does not automatically release the hotel from responsibility for its performance of the contract.
8. Prices, payment and advance payments
- The base rate for caring for a cat is PLN 100 per day. The final amount depends on the agreed dates, length of stay, number of cats and care required. Higher rates apply at Christmas, Easter, New Year’s Eve and New Year’s Day; the specific amount must be stated in advance.
- The confirmation specifies the start and end times and how days and partial periods are charged. A full extra day is not automatically charged for every delay unless that method has been properly agreed and is appropriate to the circumstances.
- A three-hour stay, transport and additional services require a separate agreement on availability, scope and price. The absence of a published price does not allow arbitrary later charges. Prices quoted to customers are final and include any applicable taxes.
- An agreed advance payment is credited towards the stay and accounted for when the contract ends or is cancelled; it is not automatically non-refundable. A statutory earnest-money deposit under Polish law (zadatek), rather than an advance payment (zaliczka), requires a separate express agreement about its amount and legal consequences. This draft does not establish a zadatek.
- Payment methods and deadlines are provided before the contract is concluded. Additional food purchases, transport and other expenditure require consent, except for necessary emergency assistance described in these terms. The final statement should itemise the charges.
9. Changes, cancellation and early collection
- The owner should report a change of plans as soon as possible, preferably in a message recording when the notice was given and what is changing. A phone conversation can be confirmed by message.
- An unconfirmed enquiry can be withdrawn without charge. Changing confirmed dates depends on availability; the hotel does not guarantee a move to any chosen date or the same price for a different period.
- On cancellation, the hotel accounts for services actually provided and any justified, evidenced costs or loss where recovery is legally permitted. The customer is not automatically charged the full price of an unprovided stay. Saved costs and any rebooking of the released space are taken into account.
- If the operator wishes to introduce fixed late-cancellation or no-show charges, a lawful schedule must first be separately prepared, disclosed before the contract is concluded and approved. This draft does not establish such a fee schedule.
- Early collection, termination of care for an important reason and cancellation due to unmet health requirements are settled individually according to care provided and applicable law. These arrangements do not restrict statutory withdrawal rights or the right to terminate for important reasons.
- If the hotel cancels or ends a stay, it must not leave the cat without safe care. It arranges safe collection or other lawful assistance and refunds unprovided care; any further claims are assessed according to law.
10. Withdrawal from a distance contract
- This draft provides consumers with 14 days from concluding the contract to withdraw without giving a reason. That right is not excluded simply because the service is called a “cat hotel”. The legal classification of the actual contract model must be checked before implementation.
- Withdrawal can be made by an unambiguous statement, including by email or post to the operator’s address given in the confirmation. Sending it before the deadline is sufficient. The sample below is optional.
- Starting care before the withdrawal period ends requires the customer’s separate, express request and information about the consequences. Accepting the terms or submitting an enquiry does not by itself constitute that request.
- Where withdrawal follows a properly requested start, the settlement covers a proportionate part of care already provided. Loss of the statutory right after full performance of a paid service requires the legal conditions to be met, including prior consent and acknowledgement of the relevant information.
- Any refund due is made within 14 days of receiving the withdrawal statement using the original payment method unless the customer agrees to another method without extra cost. Mandatory information and a withdrawal form are supplied before the contract is concluded.
11. Collection, delays and failure to collect
- The cat is collected by the owner or a previously authorised person at the agreed time, in a safe carrier. The hotel may reasonably verify identity or authorisation, without requesting an unnecessary copy of an identity document.
- The hotel must be told promptly about any delay. Extending a stay requires agreement about space and charges. The hotel continues to take measures to keep the cat safe even if the owner misses the agreed collection time.
- If contact cannot be made, the operator records attempts to reach the owner and emergency contact and sends a request to collect the cat. Where circumstances suggest abandonment, further action follows the law, involving the appropriate authorities, municipality or animal welfare organisation as applicable.
- Failure to collect does not automatically transfer ownership to the hotel. The hotel cannot independently sell, give away or euthanise the cat because of a debt. Recoverable costs of necessary continued care are pursued on an appropriate legal basis and supported by records.
12. Responsibilities and liability
- The hotel is responsible for properly providing the agreed care and for those it uses to perform it, in accordance with applicable law. Its duty of care includes securing the premises, feeding, hygiene, observation and an appropriate response to risk.
- Liability for illness, injury, escape, deterioration or damage to belongings depends on the established facts, cause and connection with the care provided. A stay alone does not establish fault, while a pre-existing condition does not excuse the hotel’s own negligence.
- The owner is responsible for accurate information, valid authorisations, agreed supplies and timely payment. Recovery of costs caused by withholding important information requires an established legal basis, causation and evidence of the actual loss.
- Normal wear, typical behaviour of a cat whose needs were properly disclosed and routine cleaning do not automatically result in a penalty. Exceptional damage must be described, documented and assessed individually; the customer may challenge both the basis and amount claimed.
- These terms contain no blanket exclusion of responsibility for the cat’s life or health or a compensation cap equal to the stay price. They do not restrict liability that cannot lawfully be excluded or consumers’ rights. A dispute does not justify withholding the cat as a means of pressure.
13. Complaints, feedback and disputes
- Concerns should preferably be raised promptly so they can be investigated and care improved. Not raising a concern during the stay, sending a positive message or collecting the cat without comment does not automatically waive later claims.
- Complaints may be sent to the operator’s email or postal address stated in the contract, or made in person. Contact details, stay dates, a description and the requested remedy are recommended. Photographs or veterinary records can help, but accepting a complaint is not conditional on supplying every possible item of evidence.
- The hotel replies to a consumer’s complaint on a durable medium within 14 days of receiving it unless another applicable provision specifies a different period. Statutory consequences of failing to reply on time also apply. Consulting carers or a vet does not permit an arbitrary extension.
- Handling a complaint is not conditional on removing a review, giving up contact with a consumer adviser or accepting confidentiality terms. Replies are factual and do not publicly disclose customer details, records or stay information without a lawful basis.
- If a complaint remains unresolved, consumers may seek help from a consumer ombudsman and appropriate out-of-court dispute resolution bodies. The operator communicates its position on participation as required by law. Court jurisdiction follows applicable rules; the terms do not require consumers to use only the court at the hotel’s location.
14. Personal data, photographs and communications
- Information collected for a stay is used to handle the enquiry, perform the contract, process payments and deal with possible claims. Full privacy information, including the controller’s identity, lawful bases, retention periods, recipients and individual rights, must be completed before serving customers.
- Unnecessary sensitive information about people should not be supplied. Emergency-contact details should be provided after informing that person, and only as needed for the agreed contact. Access to stay records and correspondence is limited to authorised people.
- Sending a cat photograph privately as a stay update does not constitute permission to use it in marketing. Identifiable people, their details, documents and private correspondence are not published without an appropriate basis. Marketing use of photos and stay stories is agreed separately; refusal does not affect the care provided.
- An enquiry does not subscribe anyone to a newsletter. Customer calendars are not publicly accessible on this website. Any future availability feature should show only free dates, without names, contact details or notes about the cats.
15. Website and form use
- Browsing the website is free. The forms are for lawful contact and stay enquiries. A current browser, internet connection and the functionality needed to use the form must be available.
- Spam, impersonation, unauthorised-access attempts and unlawful content are prohibited. The hotel may take proportionate measures against misuse without removing customers’ ability to make complaints by another route.
- If the form fails, call +48 664 668 340. A saved-enquiry message confirms registration of the enquiry, not a booking or an assurance that a carer has read it immediately.
- Images are illustrative unless explicitly identified as photographs of the actual premises. The precise room standard and service should be confirmed before the contract is concluded. The Po Kociemu name and cat mark must not be used to imply a non-existent partnership or impersonate the hotel.
16. Version of the terms and individual arrangements
- The contract is assessed according to the version accepted when it was concluded. Later website or terms changes do not automatically alter an ongoing stay or a confirmed price. Individual arrangements are recorded and cannot override mandatory law.
- If a provision is ineffective, the applicable law takes its place without automatically invalidating the remaining terms. Customers retain rights granted by Polish law and any other mandatory provisions protecting them.
- This document remains a review draft. Before contracts are offered, complete the operator’s details, full address, active email, arrival and collection times, day-counting rules, approved extra prices, cancellation settlement rules, emergency procedure and full privacy information. A lawyer should review the terms and contract forms in light of how the service will actually operate.
